Potentialities of human rights: Agamben and the narrative of fated necessity.Ayten Gündoğdu - 2012 - Contemporary Political Theory 11 (1):2-22.
Giorgio Agamben presents us with one of the most powerful and controversial criticisms of human rights. He contests conventional understandings of human rights as normative setbacks on sovereign power, and shows instead how these rights reinforce sovereignty by producing bare lives that are irredeemably exposed to violence. This essay aims to understand the distinctive aspects of Agamben's critique and assess his concluding call for a politics beyond human rights. It suggests that this call is necessitated by a counternarrative of Western (...)

    Wert-Ausgleich-Bildung: Schelers Späte Europa-Idee Als Eine Bildungsaufgabe.Evrim Kutlu - 2023 - Phenomenology and Mind 25 (25):48.
In confrontation with the current events of his time, Max Scheler develops his idea of a “new Europe”, which is to emerge from the ruins of the First World War in confrontation with “capitalist England” and through the awakening of a new religiosity. From the 1920s onwards, the idea of unity under Catholicism is overcome and raised to a higher level to a global and cosmopolitan level. Scheler speaks of a “cosmopolitanism” that needs to be learned and will ultimately entail (...)

Shadow regionalism in immigration enforcement during COVID-19.Fatma Marouf - 2023 - Theoretical Inquiries in Law 24 (2):241-266.
Stark variations exist in U.S. immigration enforcement. These variations have persisted even during the COVID-19 pandemic, when special measures that should have constrained variations were in place. This Article argues that variations in discretionary enforcement decisions based on resistance to national policies, bias, illegal tactics, or arbitrariness are unjust and should be curtailed. The Article first distinguishes between transparent sources of variation in immigration law and variations that stem from non-transparent, discretionary determinations. Within the category of discretionary determinations, the Article (...)

The Problem of Evil in Mawl'n' and Theodicy of Contrasts.Fatma YÜCE - 2022 - Cumhuriyet İlahiyat Dergisi 26 (3):1003-1019.
The problem of evil and theodicy is one of the most important subjects in the field of Philosophy of Religion. The problem of evil is basically understood as the problem of incompatibility of the existence of God with evil. While the problem of evil is used to justify atheistic claims, theodicy has been developed to strengthen theistic claims. Mawlânâ D̲j̲alāl al-Dīn Rūmī (1207-1273), who is the important sufi thinker of Turkish-Islamic culture, is generally known for his mystical and literary works. (...)

İngiliz Erken Dönem Şiîlik Çalışmaları ve Thomas Herbert Örneği.İbrahim Babur Gündoğdu - 2018 - Kader 16 (2):484-503.
İngilizler, Oryantalizm alanında önemli çalışmalar ortaya koymuşlardır. Geçmişte İngilizler ilk dönemlerinden itibaren İslamiyet hususunda bilgi birikimleri üst seviyelere ulaştığı halde, Şiîlik çalışmaları işin içine dâhil olduğunda daha geç tarihlere rast gelmiştir. İngilizlerin Şiilik alanında çalışmalarının hayata geçmesiyle ilginç hususiyetler kendini göstermiştir. Bilgi-siyaset, siyaset-bilgi denklemleri İngilizlerin Orta Doğu coğrafyasındaki etki ve icraatlarında değişmeyen hareket noktası olmuştur. Safevîler döneminden başlayarak, Dünya savaşları sürecinde saha hâkimiyetlerinin arka planında yüksek bilgi birikimi kendini göstermiştir. Ortadoğu bugün bile bu etkiden hala kurtulamamıştır. Çalışmamızın ana ekseni olan (...)

The aim of the present study is to evaluate Sonja Foss’s Rhetorical Schema for the Evaluation of Visual Imagery as well as reflect upon several points for further consideration; and finally suggest a renewed triadic approach as a method for analyzing art-relevant visual imagery. The triadic approach to be discussed assumes three correlative layers: the intellectual knowledge, function of the artistic content as the visual representational component, and aesthetics as modality. Wrongful Death: Oklahoma Supreme Court Replaces Viability Standard with "Live Birth" Standard.Fatma Marouf - 2000 - Journal of Law, Medicine and Ethics 28 (1):88-90.
On December 7,1999, a divided Oklahoma Supreme Court held in Nealis v. Baird that a claim may be brought under Oklahoma's wrongful death statute on behalf of a nonviable fetus born alive. The decision represents a departure from the traditional notion that “viability”—the ability of a fetus to sustain life outside the womb with or without medical assistance—is the standard for wrongful death recovery. In replacing the “viability” standard with a “live birth” standard, the majority maintained that live birth is (...)

This study examines the relationships among intrinsic and extrinsic religious orientations, locus of control and depression levels of 430 Turkish Muslim university students. The results show that some locus of control dimensions are related to participants’ religious orientations, but depression has no significant impact on intrinsic or extrinsic religiousness. Hierarchical Regression Analyses were conducted for predicting the intrinsic and extrinsic religious orientations of different gender. Belief in chance and belief in fate contribute to male and female participants’ intrinsic religious orientations. (...)

Border Deaths as Forced Disappearances: Frantz Fanon and the Outlines of a Critical Phenomenology.Ayten Gündoğdu - 2022 - Puncta 5 (3):12-41.
This article aims to examine the racialized forms of violence enacted by contemporary border regimes by rethinking border deaths as “forced disappearances." Although “forced disappearance” is often associated with military dictatorships, I extend it to border control policies that push migrants beyond the pale of the law, make it difficult to find out about their fates or whereabouts, and render their lives disposable. In thinking about border deaths as forced disappearances, I move beyond the strictly juridical meaning of this term (...)

  22. ‘Perplexities of the rights of man’: Arendt on the aporias of human rights.Ayten Gündoğdu - 2012 - European Journal of Political Theory 11 (1):4-24.
This article provides a new interpretation of Hannah Arendt’s critical analysis of the ‘perplexities of the Rights of Man’ by drawing attention to its overlooked methodological orientations, especially its ‘aporetic’ nature. Arendt’s critique is aporetic as it centres on the paradoxes of human rights and analyses them by putting into practice a mode of inquiry that she associates with Socrates. The article challenges the conventional understanding of aporia as a paralysing impasse and suggests that aporetic thinking can create possibilities of (...)

On al-Māzarī's Understanding of Usūl.Fatma Hazar - forthcoming - Atebe.
Māzarī al-Tamimī (d. 536/1141) was one of the last jurists who lived in North Africa before the fall of al-Andalus. He is the author of Izāḥ al-Mahsūl, which is considered to be an important turning point in the formation of the uṣūl al-fiqh structure of Mālikī jurisprudence. The lack of studies on the uṣūl al-fiqh of al-Māzarī, who had considerable knowledge in the fields of ḥadīth, fiqh, theology, medicine, and fatwā, made this study necessary. This study examines al-Māzarī's understanding of (...)

It is intended to facilitate reading, learning and memorization, or to eliminate difficult parts in a book written in the form of Ikhtisâr. The compilation of concise works that fulfilled their purpose has become widespread over time and transformed into a tradition and also concise works have been compiled in fiqh as in other disciplines of sciences. The Incorporation of Sufism into Religious Studies in Line with the Understanding of Morality of the Early Period.Fatma Gülseroğlu - 2021 - Atebe 5:105-119.
The issue of morality is a universal phenomenon that is spoken and discussed above religions. There are moral values that every society accepts depending on their sociological and psychological conditions. From the first moment Islam came to the Arab society, it began to organize and renew the moral values of the society. As a model of the regulated and renewed moral values, The Prophet is shown. In this context, the moral consequences of the confusion in the Islamic society after the (...)

Consistency and Balance Model in Morality: Between Excess and Defect, an Ob-jective and Holistic Approach.Fatma YÜCE - 2019 - Cumhuriyet İlahiyat Dergisi 23 (3):1257-1277.
In this study, Consistency and Balance Model (CBM) is proposed and introduced. In the context of the model, the importance of consistency is emphasized in morality just like in Philosophy. Therefore, CBM gives the reason prominence in morality to ensure the consistency and according to CBM the emotion, the intuition and the conscience in addition to the reason, are also important. In order to see the principles determined by the reason in human behaviors, two kinds of classification are developed for (...)

The Main Theories of the Relationship Between God and the Universe in the Islamic Thought: Origination (Ḥudūth), Emanation (Ṣudūr), and Manifestation (Ẓuhūr).Fatma Aygün - 2018 - Kader 16 (1):157-187.
In this study, we will analyze the three major theories concerning the relationship between God and the universe: origination (ḥudūth), emanation (ṣudūr), manifestation (ẓuhūr or tajallī). The theory of origination was developed in the history of Kalam. The majority of the theologians (Mutakallimūn) aimed to offer a concept of God and His relation to the universe based on the origination theory. On the other hand, the Muslim philosophers, mostly Ibn Sīnā, suggested the theory of emanation to provide a causal explanation (...)

A genealogy of the relationship between Islam and knowledge focusing on the Muslim West and, in particular, Algeria explains the current chaos within Muslim societies. The West, on its side, has difficulties understanding a cultural tradition which differs from its own. Islam did develop an aptitude for knowledge that put into play ‘different intellectual modalities, among which were dialectic argument, intuition and controversy’. However, ‘the accession to knowledge is shown by assent’. A long tradition of debate and controversy drew to (...)
